Epic Ride Weather Events — Terms of Use

1. The Site and What We Provide

The Site provides tools to browse and share event information and weather-related previews (for example: event pages, routes, and forecast visualizations). The Site may allow users to create and publish event pages that other users can view.

No payments on the Site. We do not process payments on the Site. Events may link to third-party sites (for example, registration platforms) that have their own terms and policies.

We may change, suspend, or discontinue any part of the Site at any time.

2. Eligibility

You must be legally able to form a binding contract in your jurisdiction to use the Site. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts (Optional)

You may browse the Site without an account. Some features (such as creating, editing, or managing events) may require an account.

If you create an account, you agree to:

• provide accurate information where requested;
• keep your login credentials confidential; and
• be responsible for all activity that occurs under your account.

We may suspend or terminate accounts as described in these Terms.

4. User Content

4.1 What is "User Content"

"User Content" includes any content you submit or make available through the Site, such as event names, descriptions, dates, links, routes, images (if supported), and other materials.

4.2 Ownership

You retain ownership of your User Content as between you and Epic Ride Weather.

4.3 License You Grant Us

By submitting User Content, you grant Epic Ride Weather a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, cache, reproduce, display, publish, perform, distribute, and modify (for formatting or technical delivery only) your User Content in connection with operating, improving, and promoting the Site and making your content available to others as you direct (for example, publishing an event page publicly).

This license continues until your User Content is removed from the Site, except that:

• copies may persist in backups for a limited period; and
• content that has been shared or reposted by others may continue as permitted by those users and the Site's features.

4.4 Your Responsibilities and Promises

You represent and warrant that:

• you have all rights necessary to submit and publish your User Content (including any required permissions from event organizers, photographers, or rights-holders);
• your User Content is accurate to the best of your knowledge and not misleading;
• your User Content does not violate any law or infringe any third-party rights (including copyright, trademark, privacy, or publicity rights); and
• your User Content does not include malicious code or attempt to exploit the Site.

4.5 Moderation and Removal

We do not guarantee that any User Content will be posted or remain available. We may review, remove, edit, or refuse to publish User Content at any time, for any reason, including if we believe it violates these Terms or may create risk or harm.

5. Acceptable Use

You agree not to:

• use the Site for unlawful, harmful, fraudulent, or abusive purposes;
• impersonate others or misrepresent your affiliation with an event, organizer, or brand;
• post content that is defamatory, harassing, hateful, or threatening;
• upload viruses or other malicious code, or attempt to interfere with the Site's operation or security;
• attempt to gain unauthorized access to accounts, systems, or networks;
• scrape, crawl, or harvest content or data from the Site using automated means without our prior written consent (except as permitted by law);
• reverse engineer, decompile, or attempt to derive source code from the Site (except to the extent such restriction is prohibited by applicable law); or
• use the Site in a way that imposes an unreasonable or disproportionately large load on our infrastructure.

We may restrict, rate-limit, or block access to protect the Site and other users.

6. Our Intellectual Property

The Site (including its software, design, layout, logos, trademarks, and non-user content) is owned by Epic Ride Weather and/or its licensors and is protected by intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for its intended purpose.

Except for the limited license above, you may not copy, modify, distribute, sell, lease, or create derivative works from any part of the Site without our prior written permission.

7. Third-Party Services and Links

The Site may display, link to, or rely on third-party services or content ("Third-Party Services"). Examples may include:

• event registration or organizer websites linked from event pages;
• weather data sources (including Apple Weather); and
• infrastructure providers used to host and deliver the Site (including Google Cloud Platform).

Third-Party Services are provided "as is" by their respective providers. We do not control Third-Party Services and are not responsible for their content, accuracy, availability, or policies. Your use of Third-Party Services may be subject to those providers' separate terms and privacy policies.

8. Weather, Forecasts, and Safety Disclaimers

Weather is inherently uncertain. Forecasts, route-based estimates, and related visualizations may be inaccurate, incomplete, delayed, or unavailable. Conditions can change rapidly and vary over short distances.

Not a safety or emergency service. The Site is not a substitute for professional advice or official warnings. Do not rely on the Site for safety-critical decisions. Always use appropriate judgment and consult official sources (for example: local forecasts, alerts, road/route conditions, and event organizer guidance), especially when health or safety may be affected.

You are solely responsible for your decisions and actions (including planning, travel, and participation in events and activities).

9. No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, QUIET ENJOYMENT, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• EPIC RIDE WEATHER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
• EPIC RIDE WEATHER'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED FIFTY CANADIAN DOLLARS (CAD $50).

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, certain consumer protection rights).

11. Indemnification

You agree to defend, indemnify, and hold harmless Epic Ride Weather and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• your User Content;
• your use of the Site;
• your violation of these Terms; or
• your violation of any law or any rights of a third party.

We may assume control of the defense of any matter subject to indemnification, and you agree to cooperate with our defense.

12. Termination and Suspension

You may stop using the Site at any time.

We may suspend or terminate your account (if any), restrict access, or remove User Content at any time if we believe you have violated these Terms or if we believe suspension/termination is necessary to protect the Site, users, or third parties.

Sections that by their nature should survive termination will survive (including Sections 4, 6, 8–15).

13. Privacy

Our handling of personal information is described in our Privacy Policy (if posted). Even though we do not use analytics cookies, the Site may use strictly necessary mechanisms (for example, essential cookies or similar technologies) to support login sessions, security, and basic operation.

14. Governing Law and Venue

These Terms are governed by the laws of the Province of British Columbia, Canada, excluding its conflict of laws rules.

To the extent permitted by law, you agree that any dispute arising out of or relating to these Terms or the Site will be brought in the courts located in British Columbia, and you consent to their jurisdiction and venue.

15. Miscellaneous

• Entire Agreement. These Terms are the entire agreement between you and Epic Ride Weather regarding the Site and supersede any prior agreements on that subject.
• Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
• No Waiver. Failure to enforce any provision is not a waiver.
• Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, sale of assets, or by operation of law.
